PRESIDENT TRUMP DISMISSED REQUESTS TO DEPLOY THE NATIONAL GUARD BEFORE JANUARY 6?

No.  In fact, he offered to deploy the National Guard

Background: This is yet another Chapter dealing with the “January 6 Committee” or “J6 Committee.”  If you made it this far, chances are you know what the J6 Committee is (it is a gaggle of Democrat hacks, along with a couple of has-been Never Trumpers, spreading misinformation, propaganda and lies about January 6, 2021, President Trump, Trump supporters and Republicans – those are my opinions anyway) and, if so, feel free to skip this background section.

The J6 Committee is actually the “Select Committee to Investigate the January 6th Attack on the United States Capitol” established by the Democrat majority in the United States House of Representatives. See here.  The Republican Party members in the United States House are not formally participating in the J6 Committee, after the Democrat Speaker of the House, Nancy Pelosi, refused to allow the House GOP Leader, Kevin McCarthy, to select all of the Republican representatives to serve on the panel.  See here.  The J6 Committee consists of all Democrats and two Never Trump Republicans (who are participating without the approval of the Republican House Leader), Liz Cheney from Wyoming and Adam Kinzinger from Illinois.  The willingness of Reps. Cheney and Kinzinger to serve on the J6 Committee, and their willingness to support what many observers view as an illegitimate committee, running roughshod over the rights of Americans, and their willingness to attack fellow Republicans, earned them a rare censure resolution from the Republican National Committee.  See here.

The J6 Committee is supposed to be conducting an investigation into the January 6, 2021, U.S. Capitol riot.  The J6 Committee came about after the effort to establish a formal commission was blocked in the United States Senate by Republicans.  See here.

The J6 Committee and its members engaged in some questionable conduct in their effort to build a narrative against President Trump surrounding the events of January 6, 2021.  (The story covered in this Free Chapter is an example, while some other equally dubious J6 Committee activities are covered in the Fake News Exposed about Trump series.)  The misconduct and abuse of power by the J6 Committee are bad enough, but the hiring of a TV Executive to produce the hearings lead many to conclude the entire production is propaganda.

Further exposing the J6 Committee as a pure propaganda ploy is the person the Democrats selected to chair it, namely, Mississippi Democrat Congressman Bennie Thompson. Congressman Thompson is a long-time sympathizer of the Republic of New Afrika and some of its membership. For the uninitiated, the Republic of New Afrika (RNA) is a revolutionary, militant black organization formed in 1968. One of the goals of this revolutionary organization is the establishment of an independent “New Afrika” nation consisting of the states of Louisiana, Mississippi, Alabama, Georgia and South Carolina. Various leaders and members of the organization were involved in shootouts with police and the FBI over the years. Some of these episodes are outlined in the article by John Solomon cited above.

Rep. Thompson’s affiliations with RNA began when he was an Alderman in Bolton, Mississippi back in 1971 when he publicly attacked police after some RNA members were arrested. As recently as 2013, when the former Vice President of the Republic of New Afrika, Chokwe Lumumba, ran for Mayor of the City of Jackson, Mississippi, Congressman Thompson supported him. In fact, Rep. Thompson participated in campaign ads for Lumumba. When the revolutionary black militant won the Jackson Mayor’s race, Rep. Thompson officiated at his induction ceremony. See Just the News.

This is the guy the Democrats put in charge of investigating an alleged “insurrection?” A man linked to a radical, revolutionary, black militant group which aims to declare a new homeland in five U.S. states? The fact the Democrats put this guy in charge of the J6 Committee tells the world just how serious the Democrats are about the so-called “insurrection” on January 6, 2021.

Another fact to keep in mind as you read this Chapter is the individuals appearing before the J6 Committee are not providing what would ordinarily be characterized as “testimony.”  At best they are giving sworn statements, while some apparently are sitting for “interviews.”  The reason this is not the normal routine is the only individuals asking the questions were the J6 Committee lawyers or committee members.  No lawyers for any opposing interests – such as Republican House members, their attorneys or attorneys for any of the individuals implicated by her claims – were able to participate.

THE FAKE NEWS

President Trump failed to make the military available to protect the United States Capitol in the days leading up to January 6, 2021.

Who Pushed the Fake News?

The January 6 Committee (aided by virtually every Fake News Media outlet in existence which parroted the J6 Committee’s messaging).

On January 6, 2021, the acting Secretary of Defense for the Trump Administration was Chris Miller.  On July 26, 2022, the J6 Committee released just under a two minute snippet of an interview with former Secretary of Defense Miller wherein Miller states he was not given an order by President Trump to have 10,000 national guards soldiers ready for January 6, 2021.  See here.

The J6 Committee in the text of the tweet accompanying the video stated, in part, “. . . Trump failed to give any order prior to January 6 to deploy the military to protect the Capitol.”  See here.

The Fake News Media jumped on this story.  Additional hype and promotion accompanied these stories, because President Trump claimed he “suggested & offered up to 20,000 National Guard or troops, be deployed in D.C. because it was felt the crowd was going to be very large.”  See Truth Social.

Also, Fake News Media claimed the audio released by the J6 Committee showed former Secretary of Defense Miller contradicted himself.  See Newsweek:

THE TRUTH

As is so often the case, getting to the truth of this story takes some work, so bear with me.  In short, President Trump DID authorize the use of Federal military personnel to defend the Capitol, however, it is generally illegal under Federal law for the President to order the deployment of Federal military personnel for domestic law enforcement purposes.  Such assistance must be requested by civilian authorities.  The only request for Federal military assistance was made by the Mayor of Washington, D.C., on December 31, 2020 and she only requested unarmed personnel.  Therefore, President Trump authorized the assistance, but the civilian authorities did not request it.

(Keep in mind, the District of Columbia is not a State.  Under Executive Order 11485, issued in 1969, the National Guard in the District of Columbia is under the command of the U.S. Secretary of Defense.)

First of all, we know on January 3, 2021, President Trump did authorize the National Guard to be used to protect the U.S. Capitol on January 6, 2021.  How do we know?  Because the Inspector General of the United States Department of Defense (DODIG) conducted an extensive investigation into the DOD’s involvement in the preparations for the January 6 protests and the aftermath.  These facts are confirmed in the DODIG Report, issued on November 16, 2021 and formally named, “Review of the Department of Defense’s Role, Responsibilities and Actions to Prepare for and Respond to the Protest and its Aftermath at the U.S. Capitol Campus on January 6, 2021.”

The Report relates that former Acting Secretary of Defense Chris Miller and General Mark Milley, the Chairman of the Joint Chiefs of Staff, met with President Trump at the White House at 5:30 p.m. on January 3, 2021.  The report then states:

The primary topic they discussed was unrelated to the scheduled rally. GEN Milley told us that at the end of the meeting, the President told Mr. Miller that there would be a large number of protestors on January 6, 2021, and Mr. Miller should ensure sufficient National Guard or Soldiers would be there to make sure it was a safe event. Gen Milley told us that Mr. Miller responded, “We’ve got a plan and we’ve got it covered.”

See DODIG Report, pg. 31.  This is an exhaustive, thorough report about the Department of Defense’s involvement in the events surrounding January 6, 2021.  It is not the result of the political machinations of some one-sided Democrat hack political propaganda committee.  The DODIG’s report confirms President Trump raised the issue of the need for sufficient National Guard troops to be present to ensure the events of January 6 did not get out of hand.

This meeting with President Trump on January 3, 2021, is also reported on in the United States Senate Report on January 6, 2021, entitled, “Examining the U.S. Capitol Attack: A Review of the Security, Planning, and Response Failures on January 6 (Staff Report),” see pg. 77.  This report confirms President Trump agreed with a request from the Mayor of Washington, D.C., for a small contingent of National Guard troops (more on this below).

These facts were again confirmed by former Secretary of Defense Chris Miller and Kash Patel, who was Chief of Staff to SecDef Miller in January 2021, on an appearance on the Sean Hannity on Fox News on June 7, 2022, where both confirmed President Trump authorized up to 20,000 National Guard troops.

In an interview with Vanity Fair in January 2021, shortly after the Capitol Riot, Former Secretary of Defense Miller confirmed President Trump contended at least 10,000 National Guard troops would be needed and authorized the use of NG troops.

Is the J6 Committee Audio Only Snippet Inconsistent?

The Fake News Media claims former Secretary of Defense Chris Miller’s interview with the J6 Committee contradicts his other statements.  That is not actually true.  Allow me to elaborate.

First of all, the J6 Committee only released a small part of SecDef Miller’s interview.  Always be wary of “snippets,” especially when political hacks pushing propaganda are the ones releasing the snippets.

In the portions of the interview released, SecDef Miller says he was not given “any direction or order” to have 10,000 National Guard troops “to be on the ready,” and that there was no “direct order” from President Trump for 10,000 National Guard troops.  See J6 Committee Twitter page.

Former Acting Secretary of Defense Christopher Miller’s interview with the J6 Committee does NOT contradict his statements on Sean Hannity’s Fox News show and is consistent with the DODIG and Senate Reports.

The 1878 Posse Comitatus Act, 18 USC §1385, prohibits the use of active duty Federal military personnel to enforce U.S. laws within the borders of the United States.  This prohibition applies to National Guard troops when they serve in what is known as “Title 10 status” (which occurs when the President calls up NG troops to active duty or “federalizes” them, otherwise NG troops are under the control of States).

The United States Department of Defense (DOD) may provide support for civilian authorities only under specific circumstances.  The DOD refers to those circumstances as “Defense Support of Civilian Authorities” or DSCA.  This is covered at length in the DODIG Report, pgs. 11-13.  As stated in the report at page 11:

Before providing DSCA in response to each RFA, the DoD must determine the specific legal authority that directs or allows the requested support.

How Many Requests for Assistance Were Received?

Civilian authorities sent one lone request for assistance from the D.C. National Guard DCNG).  That request was made by D.C. Mayor Bowser on December 31, 2020.  This Request for Assistance asked for NG troops to “Six (6) crowd management teams to manage crowds at specified Metro stations” and “a team to assist at thirty (30) designated traffic posts.” The request further outlined that “No DCNG personnel will be armed during this mission.”  DODIG Report, pgs. 103-04.

This request was approved and the personnel were provided.  SecDef Miller confirmed President Trump authorized him to handle and approve any such requests. United States Senate Report, pgs. 76-77.

The Mayor of D.C. provided another letter to the Acting Secretary of Defense, Secretary of the Army and Acting U.S. Attorney General on January 5, 2021, insisting that no Federal military or law enforcement personnel (other than those they already planned for) be deployed in the District of Columbia on January 6, 2021.

The United States Capitol Police did not request any assistance, though offers of assistance were made to USCP Chief Sund.  (See the United States Senate Report, pg. 76.)  In testimony before the United States House of Representatives in 2019, USCP Chief Sund testified he asked for permission from U.S. House and Senate security officials to request Federal military assistance but they denied his request, claiming the “optics” of Federal troops in D.C. would be bad.

How about that?

Commentary:  In the days leading up to January 6, 2021, President Trump specifically inquired of the Secretary of Defense and the Chairman of the Joint Chiefs of Staff if they were prepared for the crowds on January 6, 2021, and authorized them to take whatever actions were necessary to control the crowd, including authorizing the use of thousands of National Guard troops.  Federal law, however, prohibited him from legally ordering Federal military personnel to deploy in D.C. for law enforcement purposes.  So, he did not issue any such orders.  The Federal military personnel could only deploy in support of civilian authorities based upon a specific request for such assistance.  The only such request received before January 6, 2021, was the Mayor of Washington, D.C.’s request for some unarmed National Guard troops sent on December 31, 2020.  The requested unarmed troops were provided.  The Chief of the U.S. Capitol Police wanted to ask for NG troops, but his superiors denied his requests concerned about the “optics.”  Trump Administration officials checked multiple times with relevant civilian authorities to see if additional requests for assistance would be made before January 6.  No additional requests for assistance were made.

In the snippet of the interview aired by the J6 Committee former Acting Secretary of Defense Chris Miller simply confirmed President Trump did not “order” the National Guard to have 10,000 troops to descend on or to be ready to descend on the Capitol without any request from civilian authorities.  You better believe the hacks on the J6 Committee and in the Fake News Media know the civilian authorities had to formally request the Federal military’s help.
The real mistake here was former White House Chief of Staff Mark Meadow’s comment on Fox News on February 7, 2021, where he stated 10,000 National Guard troops were told to be ready by the Secretary of Defense on President Trump’s direct order. That is what the J6 Committee interviewer asked SecDef Miller about in the snippet of audio. President Trump actually authorized the use of the National Guard before January 6 and suggested as many as 10,000 or 20,000 troops would be needed.  But, civilian authorities needed to request that assistance and they did not.  (One might conclude the D.C. officials wanted the situation to get out of hand on January 6, but that is another story for another time.)

This is another situation in which President Trump would be assailed by the Democrats, Never Trumpers and Fake News Media no matter what he did.  If President Trump actually ordered Federal military personnel (which includes the D.C. National Guard) to deploy in Washington, D.C., without any request from civilian authorities, the radical leftists in the Democrat Party, along with their like-minded Never Trumpers would have impeached him, and otherwise attacked him endlessly, for violating the Posse Comitatus Law and being a “dictator,” who abused his power.  If he merely authorized the use of Federal military personnel upon request, then he “failed to deploy the military.”  Do you see how this works?

The extensive investigations by the Department of Defense and the United States Senate report both confirm President Trump was concerned about the potential for the crowd to get out of control on January 6, 2021, and authorized Federal military personnel to be used in accordance with the law.  The real point of the January 6 Committee’s lies is to mislead people into believing the opposite.

Read the DODIG Report and the United States Senate Report and you will see how many times Federal authorities reached out to civilian counterparts to see if the civilians wanted Federal military assistance with January 6 crowd control and defense of the Capitol.  There are page after page in both reports covering these issues. If the Fake News Media (or J6 Committee) had any integrity they would question why the offers of Federal troops were turned down.  That is the real story here.
